COURTHOUSE,
Jan 15 – A 61-year old man who
came to the US at 3 year old
from Yugoslavia was detained
by ICE on January 14 at
LaGuardia Airport.
He filed a
habeas corpus petition on
January 15 in the U.S.
District Court for the
Southern District of New York
where Inner City Press found
it.
The
petition says "he is a native
and citizen of the former
Yugoslavia," without stating
which Balkan state. He suffers
from kidney failure.
On January 14 he
"flew from Michigan to
LaGuardia Airport, where he
was intending to fly to
Florida. He was detained by
ICE."
The case
was assigned to Judge
Katherine Polk Failla. She set
a hearing for February 4, and
ordered that he not be removed
from the US without an order
of the court allowing such
removal.
On February 4,
Judge Failla ordered Mhilli
released by noon on February
5.
The case is
Mhilli v. Francis, et al.,
1:26-cv-392 (Failla)
