In Sean Combs Trial Dawn Richard Was Grilled on Cross Now She Files in Her Civil Case

In Dawn Richard's civil case against Combs, on January 30, 2026 her lawyer filed to respond to Combs citing recent NYS cases, saying "Otis involved a single instance of sexual assault and a threat to the plaintiff, along with no assertion of equitable estoppel, while Ms. Richard alleges a yearslong pattern of retaliation, direct threats, and severe and sustained coercion supporting both equitable estoppel and equitable tolling. Her subsequent self-protective withdrawal did not render Combs’ threats dormant; it demonstrates that they remained operative and effective long after the working relationship ended. Ms. Richard should not be penalized for withdrawing from someone who made repeated, unrepudiated threats of serious harm, leading her to reasonably believe they remained in effect. Nor should Defendant reap the benefit of silencing Ms. Richard in this manner, which would undermine the purposes of equitable estoppel and equitable tolling. Moreover, whether Defendants’ conduct warrants equitable tolling is a fact-intensive issue that requires further factual development and is not suitable for resolution on a motion to dismiss."
