COURTHOUSE,
July 19 – A man "alleged" from
Mexico detained by ICE in the
Orange County Correctional
Facility filed a habeas corpus
petition in the U.S. District
Court for the Southern
District of New York on
Sunday, July 19, where Inner
City Press found it.
The
petition says that on May 19
he was detained after ICP
stopped the car he was driving
with his wife and
then-four-month-old child, adn
that on the morning of
Saturday, July 18, 2026,
officers told him he would be
move to another facility that
day. "A storm that day appears
to have postposted the
transfer" until at least July
20.
The habeas
petition was filed on Sunday
July 19 - establishing
venue - and was assigned to
Judge Katherine Polk Failla,
who ordered that the
petitioner not be moved out of
SDNY, EDNY or DNJ without
further order of the Court.
She has set a
briefing schedule and ordered
that the petition be produced
for a hear.
The case is
Aguilar Sanchez v. Mullin, et
al., 1:26-cv-6106 (Faila)
