Angel Gomez Refused Free Lawyer in SDNY Mag Court Then Pled Now Sentencing Delayed

SDNY COURTHOUSE, June 8 – Angel Gomez did not want the free lawyer assigned to him when he was brought into the U.S. District Court for the Southern District of New York Magistrates Court on June 21 on drug and guns charges.

Inner City Press was there, the only media in the SDNY Mag Court. 

  The Criminal Justice Act lawyer on duty informed Magistrate Judge Sarah Netburn that Gomez had declined to speak with him, and had returned his business card to him.

  Gomez said he wants to hire a private attorney through his mother or sister. But his mother was on a flight, he said, and his sister recuperating from a medical procedure.

 Gomez apparently declined to speak with Pre-Trial Services. Judge Netburn said she had no information about him, to make a bail determination.

  Judge Netburn said he would be detained, but should be produced in the Mag Court in a week's time.

Before then, he was indicted and his case assigned to new District Judge Jessica G. L. Clarke. On July 11, when appointed defense counsel said he would apply for bail, Judge Clark "referred any such application to the Magistrates Court." Inner City Press looked in on the proceeding but did not yet write it.

  Next it headed to Magistrate Judge Stewart D. Aaron on July 18. In advance, the prosecutors submitted a memo to Judge Aaron with photos of a person they said was Angel Gomez, with distinctive sneakers and a gun.

Jump cut to March 6, 2024, when Angel Gomez pleaded guilty: "Change of Plea Hearing as to Angel Gomez held on 3/6/2024.  The defendant enters a plea of GUILTY to Count Three of the Indictment. Plea accepted. PSR ordered. Sentencing was set for June 21, 2024 at 10:00 am

On June 6 defense counsel asked to delay sentencing "to consult with his attorney in EDNY." On June 7, Judge Clarke agreed, moving sentencing to September 17 at 2 pm.
