Nov 14 – A man who was ordered
removed from the US after
conviction for a crime of
moral turpitude has been
detained by ICE in Orange
County Jail in Goshen, New
York since May, despite his
conviction having been
vacated.
Israel
Rodriguez Nunez was convicted
of evidence tampering in 2018.
He was arrested at JFK Airport
on May 12, 2025 and has been
detained since. On
November 5 he filed a habeas
corpus petition, assigned to
U.S. District Court for the
Southern District of New York
Judge Arun Subramanian; Inner
City Press is covering the
case.
Judge
Subramanian asked the
governmental respondents to
brief "the impact of the
vacated conviction in this
case."
On November 14
the US Attorney's Office wrote
in that the question "must be
resolved in the administrative
removal proceedings, and is
not properly before this
Court."
