On Felon Arrested While NYPD Searched For Another Who Pled US Asks for 5 Years Prison

SDNY COURTHOUSE, June 26 – NYPD officers staked out 300 East 143rd Street in The Bronx on June 14, 2022, looking to apprehend a shooting suspect.

They grabbed Jarel Sable - not the suspect - but say they found on him a weapon, that as a felon it was a Federal crime to possess.

 The actual suspect was arrested the next day; Sable has been in custody since, awaiting trial on felon in possession charges.  

 On July 31, 2023 there was an evidentiary hearing before U.S. District Court for the Southern District of New York Judge John G. Koeltl. Inner City Press was there, the only media in the courtroom.

  Sable's lawyer Jacqueline Cistaro put her investigator in the case, a former NYPD officer, on the witness stand. He uthenticated photos he took on May 12, 2023 of 300 East 143rd Street (and three other buildings in the Patterson Houses), focusing on the location of security cameras and what could and could not be seen.

He said Patterson Houses' management office told him they had not kept the security tapes.

 

On October 13, the US Attorney's Office wrote in "requesting that the Court schedule a change of plea proceeding" later in October. 

On October 16, Judge Koeltl set the plea date, with trial: "re: Scheduling Change of Plea Proceeding. ENDORSEMENT: The Change of Plea proceeding will occur on October 25, 2023. If the plea does not go forward, Trial will proceed as scheduled on November 7, 2023. So Ordered. (Signed by Judge John G. Koeltl on 10/16/2023)."

On October 25 Sable did, in fact, plead guilty: "Minute Entry for proceedings held before Judge John G. Koeltl: Change of Plea Hearing as to Jarel Sable held on 10/25/2023. Deft pres w/atty Jacqueline Cistaro. AUSA Brandon Thompson. Deft enters plea of guilty to Count 1 of indictment."

In the run-up to a belated July 1 sentencing, Sable's CJA lawyer cited two years in the MDC and asked for a downward variance. The AUSA asked for a brief extension of time to file its sentencing request.

On June 26 the US Attorney's Office wrote in and asked for 60 monhts on July 1.

The case is US v. Sable, 22-cr-409 (Koeltl)
