Disputing Gun Brandishing Got Year &
Day Still Detained Now To At Least March 6

SDNY COURTHOUSE,
Feb 27 – Joshua Gumora was up
for sentencing on November 25,
2020.
He complained
that there are drugs in the
prisons he has been. He said
he is a musician and does not
belong in
jail.
U.S. District
Court for the Southern
District of New York Judge
Vernon S. Broderick held the
sentencing, which Inner City
Press
covered.
Judge
Broderick made a point of
asking Assistant US Attorney
Daniel Wolf to be sure to made
the authorities aware of
issues in the sealed
pre-sentencing report, and in
the non-sealed sentencing
submission. (Inner City Press
is not publishing them here,
nor the name of a victim which
was said in connection with a
gun brandishing charge).
Similar
follow up was not requested on
Gumora's statements about
drugs in the prisons, even
during lockdown.
But Judge
Broderick imposed a year and a
day, so that Gumora can be
eligible for good time credit.
And in 2022 Judge
Broderick ordered: "ORDER as
to Joshua Gumora. IT IS HEREBY
ORDERED THAT, on March 28,
2022, the United States
Marshals Service shall produce
Joshua Gumora, Register Number
87617-054, to the cell block
on the fourth floor of the
Daniel Patrick Moynihan United
States Courthouse, to be
released to the United States
Probation Office. SO ORDERED.

Jump cut to
January 27, 2023, when Gumora
was brought back into SDNY
Magistrates Court. Inner City
Press was there. Gumora spoke
for himself, powerfully, how
his father died while he was
in custody and, troubling,
that he was raped in jail.
Magistrate
Judge Sarah L. Cave ordered:
"ORDER as to Joshua Gumora: A
renewed bail hearing is
scheduled for Monday, January
30, 2023 at 3:30 pm and will
take place in person, in
Courtroom 18A, 500 Pearl
Street, New York, New York.

He was not
released on January 30, then
on February 6, this was
docketed: "Minute Entry for
proceedings held before Judge
Vernon S. Broderick: Status
Conference as to Joshua Gumora
held on 2/3/2023. Defendant
Joshua Gumora, in custody,
present. Violation of
Supervised Release hearing
held. Defendant arraigned on
the specifications listed on
the violations report dated
July 14, 2022. Defendant
pleads not guilty and waives
the public reading.
Defendant's bail application
is denied based on risk of
flight and failure to appear.
The next conference is set for
Friday, February 17, 2023 at
2:00 PM in courtroom 24B at
500 Pearl Street." But what
will be done on Gumora's
allegations of rape in jail?
He is a whistleblower.
On February 21,
Inner City Press went into the
courtroom Judge Broderick is
using - from which the media
is for now excluded during the
death penalty trial he is
presiding over - for Gumora's
next appearance. Judge
Broderick said to come back in
six days, that he's more
likely to order release
directly to an in-patient
facility, or a family member.
See you in a week, Mister
Gumora, he said.
God
willing, Gumora replied. He
recounted that guards are
selling drugs. As we said: a
whistleblower.
But Judge
Broderick did not see Gumora
in a week - on February 27, it
was put off until March 6:
"Edward V. Sapone, Esq. dated
February 27, 2023 re: I write
to respectfully seek an
adjournment of today's status
conference. The government, by
AUSA Dan Wolfe, the US
Probation Department, by
Officer Courtney Cooke, and I
need additional time to secure
a bed for inpatient treatment
for Mr. Gumora. We
respectfully ask the Court to
adjourn today's conference to
March 6th at 12:15 p.m.
ENDORSEMENT: APPLICATION
GRANTED. SO ORDERED: ( Status
Conference set for 3/6/2023 at
12:15 PM before Judge Vernon
