SDNY COURTHOUSE,
Jan 6 – An inability to
conduct deposition in Russia,
due to sanctions, war travel
restriction and legal issues
there has stalled a case about
a plane previously leased to a
Russian cargo airline.
BOC
Aviation Limited sued
AirBridgeCargo Airlines, LLC
over a plane worth $148
million.
On
September 14, 2022, U.S.
District Court for the
Southern District of New York
Judge Lewis J. Liman held a
proceeding. Inner City Press
covered it.
Counsel told
Judge Liman that not doing the
deposition in Russia was not
do to a lack of will but
rather a lack of law.
Judge Liman
inquired into the location of
the plane, said in the
complaint to be Hong Kong.
There is a counterclaim.
On January 3,
2023, Judge Liman held a
conference. Inner City Press
again covered it. Judge Liman
ruled that a bench trial shall
begin on June 20, 2023 at 9
am, and that the parties
should agree on a case
management plan.
On January 6, the
parties filed a joint letter
that they are discussing
whether BOCA is seeking
damages beyond the claims for
unpaid rent and the ultimate
disposition of the non BOCA
engines.
The case is BOC
Aviation Limited v.
AirBridgeCargo Airlines, LLC,
22-cv-2070 (Liman)
