Man from Ecuador Who Reentered US in 2020 Filed Habeas But Moot As Removed March 9

SDNY COURTHOUSE, March 10 –A man from Ecuador who entered the US in 2018, was detained and removed then reentered in 2020, was detained by ICE in Elmhurst, Queens.

  He filed a habeas corpus petition in the US District Court for the Southern District of New York, where Inner City Press found it.

The petition says that his detention in Elmhurst was violent.

 The case was assigned to Judge Gregory H. Woods, who asked for a US response in two weeks.

On March 9 the US Attorney's Office wrote in that the petitioner had been removed that day to Ecuador.

Judge Woods dismissed the petition as moot, adding that any appeal would not be taken in good faith and therefore IFP status is denied for purpose of an appeal."
