US Asks 6 Years on Hidalgo

Sept 27 – Moises Disla Ramos
pleaded guilty on January 2 to
an armed robbery of victim(s)
who came to buy a car and then
were shot, one in the
leg.
The plea
was before U.S. District Court
for the Southern District of
New York Judge Lewis J.
Liman. Inner City Press was
there, the only media in the
courtroom.
The Federal
Defender argued against the
presumptive immediate remand,
focusing on the conditions in
the MDC and citing two cases
by fellow SDNY District Judge
Paul A. Engelmayer.
Judge Liman
said he was not ruling that
the conditions in the MDC
could never constitute
extraordinary circumstances to
avoid remand after a plea -
but said in this case, he
would order remand. Reference
was made to having other
people's identity information.
On March 12, the
US Attorney's Office asked for
co-defendant Jerinson Rosario
to be sentenced to at least 87
months.
On March 21,
Inner City Press was present
at his sentencing, as was a
victim and the US Attorney's
Office's victim coordinator.
Judge Liman sentenced Rosario
to 78 months, telling him he
still had his life in front of
him. He ordered immediate
remand and the US Marshals
moved in.
On March 29, the
prosecutors and counsel for
co-defendant Carlos Hidalgo
Rosario were before Judge
Liman, on their request to
adjourn his trial. Inner City
Press was there, the only
media in the courtroom.
Defense counsel, who also
represents Yvette Wang in the
Kwok / Miles Guo case, asked
for an adjournment; the
prosecutor for other reasons
request one, into 2025. Judge
Liman said no, it would be
August 19, 2024, citing the
public's interest in a speedy
trial.
On April 11 as to
Moises Disla Ramos the US
Attorney's Office wrote in to
request a sentence of 120
months on April 18 - and
that's what he got, 120
months.
For a sentencing
set for October 1, the US
Attorney's Office is asking
for six years on co-defendant
Hidalgo Rosario, who wants
time served.
