Illegal Reentry Trial Set to Have Fingerprints But Defendant Pled Guilty and Gets 16 Months

SDNY COURTHOUSE, Oct 20 – A man named Eduardo Suazo Nunez a/k/a Francisco Cruz is charged with illegal reentry of the United States in an indictment in the U.S. District Court for the Southern District of New York. SDNY Judge Lewis J. Liman held a conference on March 29. Inner City Press was there, the only media in the courtroom.

  Inquiry made into an audio file in the possession of ICE. Judge Liman offered to issue an order to try to get it; the AUSA said he may write in for that. 

 The Federal Defender said the case will turn on that audio, and a possible motion. She said she does not anticipate it going to trial.

On August 8, 2024 the Federal Defender wrote in asking for another 60 days, for the remainder of the records from the Executive Office of Immigration Review (EOIR).

Jump cut to May 2, 2025 when the Federal Defenders moved to exclude fingerprint expert and the use of the word "alien" at the trial set for May 19.

On May 5 the US Attorney's Office wrote in and said "based on discussions with defense counsel, they are unable to provide additional information about defendant's whereabouts" - and that he might not appear for trial.

On May 6 Judge Liman granted the request and canceled the trial.

On May 13, the defendant was taken into custody and detained on consent.

He pleaded guilty: "Change of Plea Hearing as to Eduardo Suazo Nunez, withdraws previous plea and enters a plea of Guilty to Count 1 of the Indictment. Court Exhibit #1 - Pimental Letter. Defendant to remain in custody pending sentencing. Sentencing set for September 12, 2025 at 2:00 PM

On August 29 the Federal Defender wrote in asking for time served "to expedite his return to Honduras" - where, the memo says, he lived in San Pedro Sula, and on the island of Roatan.

On September 5, the US Attorney's Office wrote in emphasizing repeat behavior and asking for the top of its guideline: 37 months.

On September 10: "the defense currently intends to request one. However, I write to request additional time to speak with Mr. Suazo Nunez (who is detained at MDC Brooklyn) about the contours of such a hearing, and in light of counsels’ respective trial schedules, the parties request additional time to confer regarding scheduling."

On October 2 the US Attorney's Office put in an incident report from the MDC, defendant found with a blue iPhone.

He was sentenced to 16 months, as docketed on October 20: "JUDGMENT IN A CRIMINAL CASE as to Eduardo Suazo Nunez (1). The defendant pleaded guilty to count 1 of the Indictment. No open counts. IMPRISONMENT: Sixteen (16) months imprisonment."

  The case is USA v. Suazo Nunez, 1:24-cr-186 (Liman)
