Man Claiming Persecution in Georgia Detained by ICE Dec 22 Filed Habeas Now Jan 8 Hearing

SDNY Exclusive, Dec 26 – A man from the nation of Georgia was detained by ICE on December 22 while attending a required check-in with ICE in 26 Federal Plaza.

 On December 23 he filed a habeas corpus petition in the U.S. District Court for the Southern District of New York, where Inner City Press found it. 

  The petition says that he has resided in the US since 2014 after being granted withholding of removal, for which he had to "demonstrate that it was more likely than not he would be persecuted if he were removed to Georgia."

The case was referred to Judge Jennifer L. Rochon.

On December 24 Judge Rochon ordered the respondents' answer due December 30, with a hearing set for January 8 at 2:30 pm.

 Among the request are immediate release and attorney's fees.

  In a similar case on November 25, Inner City Press live tweeted an hour-long proceeding. There are two lines of cases in the SDNY, it emerged, with Judges Castel and Koeltl sending petititioners back to exhaust their administrative remedies in the immigration court, and Judge Failli (and Ho) releasing petitioners.
