Pedro
Rivera was
charged in a
multi-defendant
drug case and
on February
16, 2023 came
to plead
guilty before
U.S. District
Court for the
Southern
District of
New York
Magistrate
Judge Stewart
D. Aaron.
Inner City
Press was
there.
Judge Aaron
asked about
education -
GED - and
other matters.
The plea
agreement has
a stipulated
guideline
range of 100
to 125 months.
Sentencing
will be on
September 12
at 2 pm,
before the
assigned
District Judge
Colleen
McMahon.
Back on
December 15,
2022, Judge
McMahon held a
so-call Curcio
hearing on and
with Rivera.
Judge
McMahon asked
him of based
on a letter to
her dated
November 17,
2022, if he
understood
"that Mr.
Telesforo Del
Valle, your
lawyer, is the
subject of an
ongoing
criminal
investigation
that's being
conducted by
the US
Attorney for
the Southern
District of
New York, the
same people
who are
prosecuting
you?"
Rivera
said "yes" and
waived the
conflict.
On
December 7,
2023, the US
Attorney's
Office wrote
in asking for
48 months. Del
Valle is not
mentioned in
the six page
sentencing
letter.
On
December 14,
2023, Rivera
got 36 months.
Jump
cut to October
23, 2024 when
co-defendent
Gary Brown
appeared
before Judge
McMahon to
plead guilty,
apparently
with ten year
minimums. He
also pled to
contraband
cell phones in
the MDC - but
he was out of
custody, and
there was not
request for
remand after
the plea.

case is US v.
Hilliard, et
al., 22-cr-82
(McMahon)
Then
on March 30,
Del Valle was
arrested - and
has since pled
guilty...
