After Arrest for Stealing License Plate Bronxite In ICE Detention Files Habeas in SDNY

by Matthew Russell Lee, Patreon Book Substack

SDNY COURTHOUSE, April 6 – A 19-year-old who entered the US without documentation in 2019 and was arrested in the Bronx on November 20, 2025 and charged with stealing an NYS license plate has been in ICE detention since March 18.

On April 6 he filed a habeas corpus petition in the U.S. District Court for the Southern District of New York, where Inner City Press found it.   The case was assigned to Judge Dale E. Ho.

The petition says that "on March 18 ICE officers detained petitioner at gunpoing outside his home in The Bronx," on Tinton Avenue.

It says that "pursuant to Matter of Yajure Hurtado, no immigration judge will be able to consider Petitioner's bond request."

The case is Rivera Guzman v. Arteta, et al., 1:26-cv-2808 (Ho)
