Another Man From China Is Detained in 26 Fed Files Habeas Citing Tecate CA & Grace Church

SDNY COURTHOUSE, Jan 13 – A man from China who was detained by ICE on January 13 in 26 Federal Plaza filed a habeas corpus petition the same day in the U.S. District Court for the Southern District of New York, where Inner City Press found it.

  He entered the US on December 10, 2023 at or near Tecate, California. At his scheduled check-in at 26 Federal Plaza on January 13, he was detained and placed in removal proceedings. 

  The petition by East Broadway based counsel says that in the interim, he lived at 247-16 89th Avenue, Jamaica, New York and "is employed at a restaurant in New York and attends Church of Grace to Fujianese NJ."

  The petition is nearly identical to several Inner City Press has previously covered: also entry via Tacate, California a few days after, also attending a Grace Church. We aim to have more on this.

 Both ask for an order "that petitioner shall not be transferred outside the New York [sic] while this habeas petition is pending."  

This case is Chen v. Almodovar, et al., 1:26-cv-291 (Daniels)

Previous near-identical habeas is Liang v. Almodovar, 1:25-cv-9322 and Huang v. Almodovar, 1:25-cv-9346
