Now Indicted in SDNY

COURTHOUSE,
Oct 7 – A man arrested with a
50 round drum magazine and gun
parts from China for
conversion to automatic was
ordered released on bond on
September 4 but the US
Attorney's Office
appealed.
On
September 5 the appeal was
heard by U.S. District Court
for the Southern District of
New York Judge Margaret M.
Garnett. Inner City Press was
there, thread:
AUSA: A search of
his apartment found firearms
and tools ordered by mail from
China, ghost guns, Glilock
switches, a 50 round drum.
Everything needed for a mass
shooting.
Federal Defender:
I can't really hear.
Judge: It's a
beautiful space but the
acoustics....
Federal Defender:
There's a decision in the
District of Kansas 10 days ago
dismissing a similar 922(o)
gun charge under the Supreme
Court's Bruen decision.
Judge: This is
not a presumption case. The
offense is troubling, the
evidence is strong. He's
become a US citizen. It's a
close call but I will not
detain him.
On October 7,
Pimintel was back in the
Magistrates Court, now to be
arraigned by Magistrate Judge
Robert W. Lehrburger on the
indictment, wheeled out to
Judge Lewis A. Kaplan. He
pleaded not guilty, and Speedy
Trial Act time was excluded to
the next day's conference
before Judge Kaplan.

Pimintel, 24-cr-570 (Kaplan /
Lehrburger)
