On Man Guilty of Drugs and
Gun in Hunts Point US Asked 4
Years But He Gets Time Served

COURTHOUSE,
Oct 10 – A man charged with
selling drugs, and having a
gun as a felon, in the Hunts
Point neighborhood of the
Bronx pleaded guilty on March
20 before U.S. District Court
for the Southern District of
New York Magistrate Judge Gary
Stein. Inner City Press was
there, the only media in the
SDNY Mag Court.
The
complaint has a photo of the
gun. Remand pending sentencing
was expected, notwithstanding
the US v. Chavez decision.
But the AUSA
showed mercy: the defendant is
on dialysis, and is on the
transplant list.
Bail was
continued.
On August 21,
Hines' Federal Defender wrote
in asking for no prison time,
with medical information
redacted.
On September 20,
the US Attorney's Office wrote
in asking for four years, "to
be served at a BOP facility
that can provide adequate
medical care for the
defendant."
On September 27
Federal Defenders wrote in,
largely redacted, saying that
a "sentence of imprisonment
would be a potential death
sentence."
On October 10,
Judge Gardephe sentenced Hines
to time served and five years
of supervised release.
