In Stolen Car Sales Conspiracy Case on Named Defendant US Asked 57 Months He Gets 18

SDNY COURTHOUSE, Feb 13 – Based on arrests for a conspiracy to sell stolen vehicles, U.S. District Court for the Southern District of New York Magistrate Judge Gary Stein on August 1 held a series of presentments, detaining one. Inner City Press was there, the only media in the SDNY courtroom.

   Jeffery Montgomery had been arrested at 4:45 in the morning - meaning, picked up from custody. He consented to detention. By contrast, the SDNY prosecutors offered $50,000 bond bail to another defendant, while opposing release for another with, they said, a history of leading NYPD on car chases.  

 Judge Stein did not find grounds for detention, instead imposing the same $50,000 unsecured bond and saying that a Port Chester warrant should be dealt with. 

On August 6, co-defendant Eric Santana was before the week's Magistrate Judge, Jennifer E. Willis. She noted that he had appeared for court dates in the past, and ordered him released on $50,000 bond.

On August 13, the case was indicted and wheeled out to Chief Judge Laura Taylor Swain.

On October 14 counsel to co-defendant Boulaoute wrote in asking for time served.

On November 10 the US Attorney's Office wrote in asking for 12 months on November 17. The US Attorney's Office attached a victim impact statement asking for $17,500 in restitution for a 2021 Honda.

He got three months.

On January 28 the lead named defendant wrote in asking for time served.

On February 4 the US Attorney's Office wrote in asking for 57 month.

On February 11, he got 18 months, "net of the time the Defendant spent in custody on the related NJ conviction."

The case is USA v. Montgomery, et al., 1:24-cr-479 (Swain)
