SDNY COURTHOUSE,
Oct 4 – Back
on March 30,
2023 defense
attorney
Telesforo Del
Valle was
arrested for,
in essence,
buying
clients.
On April 28,
his paying
client Jose
Manual Perez
was asked in a
Curcio hearing
if he accepted
continuing
with
potentially
conflicted
counsel.
It
was delegated
to U.S.
District Court
for the
Southern
District of
New York
Magistrate
Judge Ona T.
Wang. Inner
City Press was
there, the
only media in
the SDNY Mag
Court.
Perez, in
detention and
with an
interpreter,
said his
children had
hired del
Valle off the
Internet. He
waived the
conflict and
said he wanted
to continue
with del
Valle. He was
told he could
not raise the
issue in the
future,
including in
any
appeal.
Jump
cut to March
11, 2024, when
the case was
pushed back
another month
to "allow the
parties to
further their
discussions
about a
pretrial
resolution."
On
June 11, 2024
Inner City
Press was in
the SDNY
Magistrates
Court when
Perez with new
counsel pled
guilty. It was
referred to
Judge Marrero
later in the
day, with
sentencing
already set
September.
On
September 10,
Judge Marrero
adjourned
sentencing
until October
4.
On
September 26
defense
counsel wrote
in asking for
no more than
60 months.
For
co-defendant
Valdez
Bautista, the
US Attorney's
Office wrote
in asking for
46 months on
October 11.
The case is US
v. Perez,
23-cr-154
(Marrero)
