COURTHOUSE,
March 12 – A man who pled
guilty to tax charges and was
sentenced to three years in
prison now wants his guns
back. Inner City Press came
upon the request in the
dockets. The US Attorney's
Office, he says, takes no
position. The gun is to go to
his brother in law, who he's known
since 2011.
U.S. District
Court for the Southern
District of New York Judge
Coleen McMahon wrote on the
letter, "If the Government is
of the position that the
weapon should be returned… the
Court will allow it."
But is that
the Government's position?
They take no position.
The case is USA
v. Elmaani, 1:20-cr-661
(McMahon)
