Oct 16 – The State of
New York filed a lawsuit in
SDNY and Judge Lewis A. Kaplan
got it, held an oral argument
and issued a TRO. Inner City
Press live tweeted it, threat
Judge Kaplan:
After 9/11 this courthouse was
a staging area, the court was
dispossessed for a time for
that reason. These grants are
to be given SOLELY on the
basis of risk of terrorist
attack. 9/11 was the 2d attack
on the World Trade Center.

Judge
Kaplan: Khalid Sheikh Mohammed
is still in Guantanamo - why?
Because of the risk of
terrorism. There was the West
Side Highway attack in which
some guy ran people over
Judge Kaplan:
Yesterday the state learned
that FEMA has zeroed out NY. I
am signing the TRO right now
and will post it online as
quickly as possible. Judge
Kaplan: I require a bond - of
$10.
On October 16
Judge Kaplan ruled: "this
Court now holds that the
withholding of these funds is
arbitrary, capricious, and a
blatant violation of the law.
It grants a permanent
injunction requiring the
federal government to grant
those funds to the MTA." Order
