Will Stay Detained in SDNY

COURTHOUSE,
March 7 – A man charged
with four attempted arsons
including one of a passenger
on the NYC subway was
presented on February 11
before U.S. District Court for
the Southern District of New
York Magistrate Judge Stewart
D. Aaron. Inner City Press was
there, the only media in the
SDNY Mag Court.
The AUSA
sought detention on
dangerousness grounds. He said
the defendant had been
arrested for slashing in mid
December but released by NYS
courts.
The
Federal Defender argued for
release, citing
treatment.
After a
break with Pre-Trial Services,
Judge Aaron ordered
detention.
On March 7 the
detention decision was
appealed to Chief Judge Swain,
de novo. Thread:
Judge Swain: Why
would a curfew and GPS
location monitoring bracelet
not be enough?
AUSA: Bracelets
can be cut. And only Probation
gets notified, not 911
emergency services.
Federal Defender:
At some point he's going to be
released. Why not do it now?
Judge: How would he travel to
the hospital and your office?
Federal Defender: Public
transportation. But this is
pre indictment.
Pre-Trial
Services: We still see no
conditions under which he
could be released and danger
to the community be avoided.
Judge: I find the government
has met its burden. You will
remain detained.
