Of Bronx Duo Arrested with Drugs and Gun in Car 1 Consents to Detention 2d Has Is Ordered

SDNY COURTHOUSE, Oct 28 – Two men were arrested in a car with drugs and a gun, on the corner of 164th Street and Prosect Avenue in the South Bronx on October 25.

  By October 27 they were presented in the U.S. District Court for the Southern District of New York Magistrates Court. Inner City Press was there, the only media in the SDNY Mag court.

   The first named defendant, with a Federal Defender, consented to detention without prejudice.

But the second, with a white shoe law firm CJA lawyer from Skadden Arps assigned, argued to be released on bond.

  Magistrate Judge Barbara C. Moses asked about the drugs - said to be in garbage can vials - and the bullet in the chamber of the gun.

 This second defendant was ordered detained as well, on both danger and risk of flight grounds.

  The case is USA v. Avila, et al., 1:25-mj-3415 (Moses)
