Mahmoud Khalil Filed Habeas Corpus in SDNY 4 am Now Judge Says Transfer to NJ

by Matthew Russell Lee, Patreon Book Substack

SDNY COURTHOUSE, March 19 – As Mahmoud Khalil was sent to the ICE detention facility in Elizabeth, NJ - and then it seems to Louisiana - his lawyer filed a habeas corpus petition in the U.S. District Court for the Southern District of New York. It was not viewable on PACER but it was, at terminals in the courthouse itself. On Bluesky here, Threads here (later, on X)

On March 10 it was assigned to Judge Jesse M. Furman who ordered: "a joint letter, no later than March 11, 2025, at 5:00 p.m., indicating whether the conference is necessary and addressing how the Court should handle the present Petition."

The letter was filed just before 7 pm, noting the US Attorney's Office's assertion is disputes on jurisdiction and possibility transferring the case, but still asking for the conference on March 12.

Inner City Press live tweeted March 12 - the Assistant US Attorney said Khalil was moved to New Jersey before the 4 am filing of the habeas petition. Judge Furman asked for briefing and ordered privileged phone calls March 12 and 13, thread here

On March 13 respondent Joyce amended his declaration, on Patreon here

On March 14 opposing return Joyce wrote in that "Khalil could not be housed at Elizabeth Detention Facility long-term due to the bedbug issue," filing on Patreon here.

On March 19 Judge Furman ruled that "the Court agrees with the Government that Khalil’s Petition cannot be heard in this District and agrees with Khalil that it should be transferred to the District of New Jersey, not dismissed or transferred to the Western District of Louisiana."

The case is M.K. v. Joyce, et al., 1:25-cv-1935 (Furman)
