To End Supervised Release Amid
Questions Now Another Gets Termination

SDNY COURTHOUSE,
Oct 29– Kelving Hernandez is
seeking an end to supervised
release, after a conviction on
drug distribution charges.
On May 9,
U.S. District Court for the
Southern District of New York
Judge Richard M. Berman held a
proceeding. Inner City Press
covered it.
Some opposition
to ending supervision was
expressed, as well as concern
that none of the forfeiture
had been paid.
Judge Berman said
this is often negotiated
between the parties; the
response was to refer to the
Financial Litigation Unit.
Jump cut to
January 11, 2024 when
co-defendant Jesus Rivera
applied to Judge Berman to
unseal other co-defendants'
sentencing minutes. An order
was proposed.
Jump cut against
to October 29, 2025 when
another co-defendant in the
case was granted early
termination: ORDER as to
Eleelin Diaz. The Court hereby
orders and directs that Mr.
Eleelin Diaz's term of
supervised release is
terminated early and effective
today, October 29, 2025. See
Tr. of Hrg. held on Oct. 29,
2025. Mr. Diaz will have
completed over four years of
supervised release. The
decision to grant early
termination of supervised
release is within the
discretion of the district
court. In sum, Eleelin Diaz
has conducted himself in an
exemplary fashion and has met
all of the requirements of
early termination of
