COURTHOUSE,
Jan 28 – Victor Montanez, a
felon, was arrested for
allegely having a gun on
October 26, 2023.
On January
9, 2024 he was writted into
Federal custody and arraigned
before US District Court for
the Southern District of New
York Magistrate Judge Robyn F.
Tarnofsky. Inner City Press
was there, the only media in
the SDNY Mag court.
Montanez'
mother was in the gallery; his
Federal Defender gave his
state court papers to her, and
explained the differences
between the two court
system.
Then he
consented to detention for
Montanez. The case has been
assigned to District Judge
Victor Marrero; a Friday
conference date was discussed,
but February 9 control date
set and Speedy Trial Act time
excluded until then.
On July 21, 2025
he pleaded guilty.
For sentencing on
January 30, 2026, the US asked
for 77 months, the Federal
Defender for 40 months.
