Felon in Possession of a Gun on Jerome Avenue Refused To Come To Court Now Wants 3 Years

SDNY COURTHOUSE, July 5 – Devin Silva, a felon, was arrested in connection with a loaded firearm near West 190th Street and Jerome Avenue in The Bronx. Now he does not want to leave his cell.

  On February 21, 2023 U.S. District Court for the Southern District of New York Judge Analisa Torres had a proceeding scheduled with Silva. Inner City Press went and covered it. 

 Before it, Judge Torres docketed that "at 8:50 a.m. the Court received an email stating that the US Marshals Service notified the US Attorney's Office that Defendant, Devin Silva, had 'refused to come to court today.' Defendant is obligated to come to Court today for a status conference scheduled for 3:20 pm. Accordingly the MDC and USMS are authorized to use reasonable force if Defendant refuses to comply."  

 In the courtroom, Judge Torres asked the defendant if he had not wanted to come. He confirmed that no, he had not wanted to. Judge Torres said it was unacceptable, as it wasted many people's time.   She set the next conference for April 26 at 10:40 am.

On February 6, 2024 Silva pled guilty.

On July 3, 2024 Silva's lawyer wrote in requesting a sentence of 36 months, with sentencing set for July 15.

The case is US v. Silva, 22-cr-705 (Torres)
