Man Whose Baby Photo
Adorned South Korea Shirts Gets a
Year to Serve Nerdy Amid Talks

Aug 7 – A company
headquarters in Korea has been
sued in New York by a
plaintiff who says the
company, Nerdy, used a baby
photo he gave them as an
aspiring model and told
T-shirts with it - in Korea.
Nerdy says there is not
jurisdiction, as does not want
to set the precedent of
settling what its counsel
calls "frivolous" lawsuits.
The plaintiff has
been given a full year - to
September 10, 2026 - to
perfect service on Nerdy.
Meanwhile a
settlement conference has been
set for November 6. On August
7 U.S. District Court for the
Southern District of New York
Judge Andrew L. Carter held a
proceeding which Inner City
Press covered.
Judge Carter told defense
counsel that the legal fees
will begin outstripping what
it might settle for - and that
a settlement would be
confidential. He said the
defendant, from Korea, should
be present at least by phone
at the settlement conference -
which will itself be
non-public.
The shirts
with the baby photo on them
are not longer being made, but
are being sold in the
secondary market for $100
apiece, having been linked to
K-Pop stars, plaintiff's
counsel said.
