Detained on Violations in SDNY

COURTHOUSE,
October 21 – Anthony Smalls
was convicted for passing
altered money orders in the
Eastern District of Louisiana.
After he served his time, his
supervision was transferred to
the Southern District of New
York.
But he
fell out of contact with
Probation and failed some drug
tests. One time, he gave a
false name, one letter off,
and a false birthday.
On
February 1, 2024 Smalls was
brought before U.S. District
Court for the Southern
District of New York
Magistrate Judge Robert W.
Lehrburger. Inner City Press
was there, the only media in
the SDNY Mag Court.
The AUSA
wanted him detained as a
flight risk.
The Federal
Defender promised to be in
touch with him to ensure
continued contact with
Probation, and appearance
before the District Judge to
which his transferred case was
assigned.
Judge Lehrburger
agreed to release him, that
same night.
Jump cut eight
month forward; Smalls was
again in the SDNY Mag court on
violations, this time before
Magistrate Judge Gary Stein.
His Federal Defender, filling
in, said Smalls now has a cell
phone. It was not enough:
Judge Stein ordered him
detained.
