SDNY COURTHOUSE,
Jan 14 –
Gabriel Roldan
was arrested
and shocked
with a taser
- he says
without cause
- on NYC's
Christopher
Street and 7th
Avenue on
October 23,
2020. He
sued.
On January 13,
2023 U.S.
District Court
for the
Southern
District of
New York Judge
Alvin K.
Hellerstein
held a
proceeding.
Inner City

it.
The City's
lawyer said
she intended
to move for
summary
judgment.
Judge
Hellerstein
asked how, if
it was he
(Roland) said,
she
said?
There's video,
the City's
lawyer
continued. It
makes it
clear.
No, Roldan's
lawyer
countered. In
the video, the
view is
obscured for
several
second. The
complaint has
a still
photograph of
the
taser.
Judge
Hellerstein
said, How
about a trial
before a
Magistrate
Judge?
No, the City's
lawyer
said.
Judge
Hellerstein
asked, Why
not?
After a pause,
the City's
lawyer said
she would have
to check with
those above
her. But
generally they
do not
consent, she
said.
OK,
said Judge
Hellerstein,
let's pick a
trial date.
April?
The City's
lawyer said
that she'll be
out of the
country.
And so May 15
was chosen for
trial.
