After Take Down of Dozen from East Harlem Johnson Houses 1 Out 1 Moving to Dismiss

by Matthew Russell Lee, Patreon Book Substack

SDNY COURTHOUSE, Jan 5 – On December 17 the SDNY US Attorney's Office announced the unsealing of an Indictment charging 12 men with a drug dealing and weapons conspiracy in the Johnson Houses in East Harlem - and a 12:15 pm press conference.   Inner City Press went, its second time of the day in 26 Federal Plaza, asked two questions and live tweeted, here

Inner City Press asked, what happened to the Wusky takedown? And how will deeming fentanyl a weapon of mass destruction be applied in New York?

Clayton: Fentanyl has killed 100,000 people. We are listening to what people want

Clayton explained Federal versus state indictment in three works: continuity of custody.

In the afternoon Inner City Press went to the U.S. District Court for the Southern District of New York Magistrates court, where co-defendant Hernandez was ordered detained as a danger to the community. Continuity of custody indeed.

On December 18 co-defendant Percy Carrion, represented by MoFo as CJA, appealed Chief Magistrate Judge Sarah Netburn's order of detention to the assigned District Judge Sidney H. Stein.

The AUSA said a gun in the utility closet was attributable to Carrion. Defense counsel said there was no video of that. He sold crack in a playground, the AUSA said. Judge Stein ordered him detained. Continuity of custody, indeed.

On January 5, 2026, a hearing with many defendants in the jury box: four in yellow, four in green, one in MDC tan. The outcome: "The next conference will be held on March 17, 2026, at 2:30 p.m., at which time the defendants will inform the Court of any motions they intend to make. Defendant Ira Boyce shall submit a letter regarding his motion for dismissal of the indictment by January 7, 2026. At the request of the government, and with the consent of each defendant except Ira Boyce, the Court excludes the time from calculation under the Speedy Trial Act from today until March 17, 2026.  All defendants remain in custody, except defendant Quadir Davonish, whose bail conditions remain as set. (Status Conference set for 3/17/2026 at 02:30 PM before Judge Sidney H. Stein)

The case is USA v. Gonzalez, et al., 1:25-cr-576 (Stein)
