Man From Peru After Arrest for Trespassing on LI Was Detained By ICE Now Freed by Judge

SDNY COURTHOUSE, May 15 –A man from Peru in ICE detention after an arrest for trespassing in Nassau County filed a habeas corpus petition in the U.S. District Court for the Southern District of New York, where Inner City Press found it. 

  On May 15 SDNY District Judge Andrew Carter held a proceeding, which Inner City Press tweeted. The Assistant US Attorney said they would still request a bond hearing before release, citing a case by SDNY District Judge George B. Daniels.

  Judge Carter said he disagrees with that case, and cited another. He ordered release by 5 pm, with certification to that effect docketed and the Government to redact information in the docket.

The case is J.J.M. v Artita et al., 1:26-cv-3184 (Carter)
