May 15 –A man from Peru in ICE
detention after an arrest for
trespassing in Nassau County
filed a habeas corpus petition
in the U.S. District Court for
the Southern District of New
York, where Inner City Press
found it.
On May 15
SDNY District Judge Andrew
Carter held a proceeding,
which Inner City Press
tweeted. The Assistant US
Attorney said they would still
request a bond hearing before
release, citing a case by SDNY
District Judge George B.
Daniels.
Judge
Carter said he disagrees with
that case, and cited another.
He ordered release by 5 pm,
with certification to that
effect docketed and the
Government to redact
information in the docket.
The case is
J.J.M. v Artita et al.,
1:26-cv-3184 (Carter)
