Shim-Larkin was to work for
the NYS Parks Department, at
the Tompkins Square Mini Pool
on East 10th Street, after
being in the lifeguard
training program and passing
the final
test. But on
the day she was to report, she
had a doctor's appointment.
Next, she had an appointment
with Immigration. Harassment
followed, and she left a
voicemail she could not
continue to work, feeling
unsafe. She sued.
On November
24, 2020 U.S. District Court
for the Southern District of
New York then Magistrate Judge
Kevin Nathaniel Fox held a
proceeding. Inner City Press
covered it.
Now more
the four years into the
litigation, Ms. Shim-Larkin
has put in to testify,
herself, as an expert witness.
The City said it
is untimely. After Judge Fox
so ruled, Ms. Shim-Larkin said
she wanted to respond. Judge
Fox to his credit did listen.
Jump cut nearly
four years to October 2024. On
October 23, according to the
docket by Magistrate Judge
Jennifer E. Willis to whom the
case was reassigned, "pro se
plaintiff Heena Shim-Larkin
adn attorney Amit Parab were
present in court. As the
proceedings began, Plaintiff
left counsel table and walked
up to the bench where Judge
Jennifer E. Willis was seated.
After plaintiff failed to
resume her seat when directed
to do so by the Court, the
Judge left the courtroom.
Plaintiff then sat at the
bench in the seat designated
for the Judge. Shortly
thereafter, Court Security
Officers arrived. Both the
CSOs and the Judge directed
plaintiff to resume her seat
at counsel table so that the
proceeding could commence.
Plaintiff was also warned that
if she did not vacate the
bench, the CSOs would be
forced to arrest her.
Ultimately, Plaintiff did not
vacate the bench and the CSOs
detained her and removed her
from the courtroom." There's
