SDNY COURTHOUSE,
Jan 24 - Sayfullo Saipov is
now in a trial that may result
in the death penalty for
killing eight people with a
van along the West Side
Highway.
On May 4,
2022 U.S. District Court for
the Southern District of New
York Judge Vernon S. Broderick
held a conference on the case
and Inner City Press live
tweet it
here
and below.
On January 6,
2023 after a
long jury
selection
that Inner
City Press
covered, some
below, Judge
Broderick
confirmed that
the trial
would start January
9. And
it did.
On
January 23,
the US put on
as witnesses
the medical
examiner and a
Bureau of
Prisons
official who
searched Saipov's
cell, thread here
On
January 24,
the US and
defense
presented
closing
arguments,
then Judge
Broderick
solicited more
submissions
for his jury
instruction. Thread here:
OK -
now in death
penalty case
US v. Sayfullo
Saipov, US
closing
statement in
liability
phase.
Assistant
US Attorney:
As bikes lay
mangled, as
FBI rushed to
the scene, as
the deceased
were IDed, as
the dust
settled,
questions
emerged. Who
did it? How?
And third,
why? Now you
know the
answers.
Saipov did it,
with 6000 lb
truck, to
become a part
of ISIS
AUSA:
Saipov sat in
the hospital
and he knew,
his mission
was
accomplished.
8 were dead.
He was the
newest
recruit. He
smiled when he
confessed.
Now
closing
statement for
Sayfullo
Saipov.
Federal
Defender
Patton: Let's
walk through
the facts,
what he
actually did,
what he said
about it in
the
interrogation
in the
hospital, and
what was found
in his
possession.
Mr. Saipov
rented a
truck...
Federal
Defender:
He veered onto
the bike path,
he killed
people, he
slammed into
that school
bus. What the
truck is
wrecked, he
gets out with
2 fake guns.
He doesn't run
away. Here are

With
Federal
Defender
distinguishing
ISIS
membership
from "Soldiers
of the
Caliphate,"
Judge
Broderick
tells the jury
to take a
break.
They're
still at it at
5:32 pm -
Judge
Broderick
ruling on
(rejecting) an
instruction
for his jury
charge. Then:
we will get
the parties a
clean version,
and go from
there.

On October
13,
2022
Saipov's
Federal
Defenders
wrote to object to
any disqualification of
anti death
penalty
jurors, focusing
on Juror 17
who cited
his religious
opposition to
the death
penalty. They
argue that
exclusion
would violate
the Free
Exercise Clause
of the
First
Amendment. Inclusion
would
guarantee no
death penalty
imposed.
The case
is US v.
Saipov,
17-cr-722
