COURTHOUSE,
Nov 10 – A man from Yemen has
been detained by ICE in the
Orange County Correctional
Facility in Goshen, New York
since March petitioning for a
writ of habeas corpus
releasing him. Inner City
Press is following the case.
On
November 10 his Brooklyn-based
lawyer wrote in to U.S.
District Court for the
Southern District of New York
Judge Aran Subramanian urging
a ruling on his pending
injunctive relief motion to
"end his now prolonged
detention."
He has argued there is no
foreseeable removal to Yemen,
given conditions
there.
Judge
Subramanian has asked for a
joint letter on the impact of
Judge Dale E. Ho's deicsion in
J.M.P. v. Areta (SDNY Oct 23,
2025) but found that "given
the factual differences
between this case and JMP, the
Court does not find that
relief based on that decision
is warranted at this time."
The case
is Al-Thuraya v. Warden, et
al., 1:25-cr-2582
