SDNY
COURTHOUSE,
Dec 18 – In the
aftermath of the shooting of
two National Guard members in
DC, on December 1 Afghan
asylum seeker Azizullah Qasemi
was notified he must appear
the next day for an ISAP
check-in at 7 Elk Street in
lower Manhattan.
He did,
then was told he had to report
to 26 Federal Plaza. There, he
was detained by ICE. His
counsel filed a habeas corpus
petition on December 3 in the
U.S. District Court for the
Southern District of New York,
where Inner City Press found
it.
Qasemi entered
the US on May 5, 2024 through
the CBP One app, and was
released on November 4, 2024.
Now, he has been detained. He
asks to be released
immediately.
On December 17
this was ordered: "The
petition for a writ of habeas
corpus is GRANTED. Respondents
are ORDERED to immediately
release Qasemi from custody by
2:00 p.m. on December 18,
2025, and certify compliance
with the Court's order by
filing an entry on the docket
by the end of the day. (Signed
by Judge Lewis J. Liman on
12/17/2025)."
On December 18
the US Attorney's Office wrote
it "to confirm that Petitioner
was released." Inner
City Press will follow the
case.
It is
Qasemi v. Francis, et al.,
1:25-cv-10029 (Unassigned)
