Man from Mexico In US Since 2012 Was  Detained by ICE Now Ordered Freed in SDNY

SDNY COURTHOUSE, Dec 8 – A man from Mexico who has lived in the US since 2012 was arrested by ICE in The Bronx on December 4. He filed a habeas corpus petition the same day in the U.S. District Court for the Southern District of New York, where Inner City Press found it.

  The petition says Edward Cid Orea is the father "to two US citizen children and has numerous US citizen and lawful permanent resident relatives." The petition goes on that "he is gainfully employed and - to the best knowledge of counsel, given the exigent circumstances of his detention - does not have a criminal history."  

The rest of the petition is similar to others recently filed in SDNY. Counsel here are Rhidaya Trivedi and Ron Kuby of West 23rd Street, who recently represented among others Brad Lander.

   The requests include immediate release and attorney's fees.

First, a hearing was set for December 8. Then docketed, on December 8, but dated December 7: "

The case is Orea v. Francis, et al., 1:25-cv-10067 (JMFORDER granting [1] Petition for Writ of Habeas Corpus filed by Edward Cid Orea: The Petition for the writ of habeas corpus is GRANTED. If counsel for Petitioner notifies counsel for Respondents by 6:00 p.m. TODAY that Petitioner prefers immediate release from his current place of detention (in Pennsylvania) over transfer back to this District before release, Respondents shall release him and certify compliance with this Order no later than 8:00 p.m. TODAY. If counsel for Petitioner confirms that Petitioner prefers transfer back to this District before release (or does not indicate a preference one way or another by 6:00 p.m. today), Respondents shall release Petitioner in this District - and file certification thereof - by 3:00 p.m. TOMORROW. The Clerk of Court is directed to close this case. The conference scheduled for tomorrow is canceled as moot.")
