Day Habeas in SDNY Citing

Exclusive,
Dec 9 – A 26-year-old woman
from China who entered the
United States on October 30,
2024 though Tecate, California
and was released was detained
by ICE on December 8.
The next
day she filed a habeas corpus
petition in the U.S. District
Court for the Southern
District of New York, where
Inner City Press found
it.
The
petition says that she was
"persecuted by Chinese
authorities for practicing
Christianity. She was detained
and beaten by the authorities
in China."
Among the
request are immediate release
and attorney's fees for
counsel based at 225 Broadway.
In a
similar case on November 25,
Inner City Press live tweeted
an hour-long proceeding. There
are two lines of cases in the
SDNY, it emerged, with Judges
Castel and Koeltl sending
petititioners back to exhaust
their administrative remedies
in the immigration court, and
Judge Failli (and Ho)
releasing petitioners.
