Exclusive,
Dec 23 – A man from
Guinea was detained by
ICE on December 21 while
"walking on Flatland Street in
Brooklyn."
On December
23 he filed a habeas corpus
petition in the U.S. District
Court for the Southern
District of New York, where
Inner City Press found
it.
The
petition says that he has
resided in the US since 2023
and "has strong claims for
immigration custody in the
form of Asylum."
Among the
request are immediate release
and attorney's fees.
In a
similar case on November 25,
Inner City Press live tweeted
an hour-long proceeding. There
are two lines of cases in the
SDNY, it emerged, with Judges
Castel and Koeltl sending
petititioners back to exhaust
their administrative remedies
in the immigration court, and
Judge Failli (and Ho)
releasing petitioners.
