COURTHOUSE,
Dec 1 – A man from China who
was presumptively detained by
ICE on December 1 and held in
26 Federal Plaza filed a
habeas corpus petition the
same day in the U.S. District
Court for the Southern
District of New York, where
Inner City Press found it.
He entered
the US on April 20, 2023 and
has been living in Flushing,
Queens. Awaiting his scheduled
check-in at 26 Federal Plaza
on December 1, he called an
East Broadway law firm. When
they lost contact with him at
11 am, they inferred detention
and filed a habeas corpus
petition.
The
complaint says he "regularly
attends services at The River
of Life Christian Church."
The
petition is nearly identical
to at least two filed in
November. We aim to have
more on this.
All three ask for
an order "that petitioner
shall not be transferred
outside the New York [sic]
while this habeas petition is
pending."
