Ex FDNY Official Saccavino Got 36 Months now Bid to Add Alcohol Abuse Program Denied

SDNY COURTHOUSE, Dec 22 – Amid the scandals swirling around NYC Mayor Eric Adams and his inner circle, on September 16 SDNY US Attorney Damian Williams announced two indictments, limited to the FDNY.   

 "Anthony Saccavino and Brian Cordasco, two former chiefs of the New York City Fire Department Bureau of Fire Prevention, are charged with bribery, corruption, and false statements offenses… in connection with a scheme to solicit and accept tens of thousands of dollars in bribe payments in exchange for providing preferential treatment to certain individuals and companies with matters pending before the BFP."

 On October 2, Judge Liman set a change of plea proceeding for Brian Cordasco on October 8 at 10 am.

For Cordasco's March 31 sentencing, on March 17 his lawyer filed asking for one year home confinement - with each and every sentencing letter withheld in full.

On March 24 the US Attorney's Office wrote in, silent as they were in US v. Greenwood on the mass sealing of sentencing letters, asking for 42 months.

On March 31, Cordasco was sentenced to 20 months in prison to start June 17, thread here.

On April 30 Saccavino's lawyer wrote in asking for no prison time - two years probation with intermittent confinement for the first year, on May 14.

On May 7, the US Attorney's Office wrote in asking for "no less than 30 months."

On May 14, he got 36: "ANTHONY SACCAVINO was sentenced to 36 months in prison for participating in a conspiracy to solicit and receive bribes in his role as the Chief of the New York City Fire Department (“FDNY”) Bureau of Fire Prevention" with surrender on August 19.

On November 18 Saccavino hired new counsel...

On December 22 his request was denied: "MEMORANDUM AND ORDER as to (24-Cr-537-1) Anthony Saccavino. Defendant Anthony Saccavino ("Defendant") moves for an order "supplementing" the presentence report in this case with what Defendant characterizes as "newly disclosed evidence" of Defendant's serious alcohol abuse. Dkt. No. 67. He argues that such "clarification" is necessary so that he receive "access to evidence-based treatment during incarceration." Id. at 2. In particular, Defendant asks the Court to supplement the presentence report with evidence of his alcohol abuse so that he can become eligible for the Bureau of Prisons Residential Drug Abuse Program (RDAP). Id. at 78. The Government opposes the motion. Dkt. No. 69. The motion is denied....[*** See this Memorandum And Order ***]... Defendant had the opportunity to provide information to the Probation Office so it could conduct its investigation. His claim now that the information he provided was not correct does not provide a basis for the Court to "clarify" the report. The motion accordingly is denied."
